- You CAN: Suggest, use, prescribe, and dispense medical products for an off-label use to your patients within the context of your medical practice. The FDA does not regulate the practice of medicine!
- You CANNOT: Advertise or sell a drug/device for off-label use directly to the consumer via the Internet.
- Why? The moment you market an off-label use online to the general public, you are no longer just “treating a patient”; you are viewed as a “seller of medical goods,” which violates FDA labeling regulations.
The Takeaway: Keep the conversation in the exam room. Your clinical judgment is protected; your website banner ads are not.
2. In-Office Dispensing: The Compliance Key
One of the biggest hurdles in treatment is patient adherence. If you hand a patient a script for a compound or niche product, there is a high chance they never fill it…or they buy a generic, ineffective substitute online.

4. A Note on “Mixing” Medications
Combining existing approved drugs (e.g., mixing two creams yourself) to create a “new” treatment can technically create a “New Drug” in the eyes of the FDA, which requires an NDA (New Drug Application).
Stick to prescribing established products or using licensed compounding pharmacies rather than mixing active ingredients in your office to avoid regulatory enforcement.
